1. Acceptance of these terms

These Terms & Conditions ("Terms") are an agreement between you and MarkMint ("we", "us", "our") covering your use of the mobile game Color Mint: Water Sort, including all of its levels, features, virtual items, in-app purchases and updates (together, the "Game").

By downloading, installing or playing the Game you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Game and uninstall it.

2. Who may play

You must be at least 13 years old (16 in the European Economic Area and the United Kingdom) to use the Game. If you are under the age of majority where you live, you may only play with the involvement of a parent or legal guardian, who accepts these Terms on your behalf and is responsible for any purchases made on the device.

3. Your licence to use the Game

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and play the Game on devices you own or control, for your own private, non-commercial entertainment. We reserve all rights not expressly granted to you. You do not buy the Game or any part of it; you licence it.

4. Acceptable use

You agree not to:

• copy, modify, translate, decompile, disassemble or reverse engineer the Game, except to the extent the law expressly allows it;
• use cheats, bots, automation, memory editors, patched builds or any tool that alters gameplay, coin balances, progress or ad behaviour;
• obtain coins, hints, cosmetic items, Color Mint Plus benefits or the removal of ads by any means other than normal play or a genuine purchase;
• interfere with ad delivery, falsify ad impressions or clicks, or attempt to claim rewarded-ad rewards without watching the ad;
• distribute, sell, rent, sublicense or publicly display the Game or its assets, or republish them in another app;
• attempt to access our systems or those of our providers without authorisation, or disrupt the Game for other players; or
• use the Game in any way that breaks applicable law.

If you break these rules we may reset your progress and virtual items, revoke benefits obtained unfairly, or stop your access to the Game.

5. Coins and virtual items

The Game includes virtual currency ("coins") and virtual goods such as bottle shapes, backgrounds and hints. You may earn them by playing, by claiming daily rewards, by watching optional rewarded ads, or by buying coin packs.

• Coins and virtual items are licensed to you for use inside the Game only. You do not own them.
• They have no monetary value, are not redeemable for cash, goods or anything of value outside the Game, and cannot be sold, gifted, traded or transferred to another player or account.
• Purchases of coins or items are for immediate delivery and are final and non-refundable, except where a refund is required by law or granted by the app store under its own policy.
• Because progress is stored on your device, coins and unlocked items are lost if you uninstall the Game or clear its data, and they do not automatically move to a new device. The Remove Ads purchase and an active Color Mint Plus subscription can be restored through your store account; purchased coins are added to your balance straight away and cannot be restored once lost.
• We may change, rebalance or discontinue coins, prices, rewards, hint costs, unlock costs or any virtual item at any time as part of balancing or improving the Game. We may also add, change or remove levels and features. This is not a breach of these Terms and does not entitle you to a refund of coins already earned or spent.

6. Purchases and Color Mint Plus

The Game is free to download. Optional paid products are offered through the Apple App Store on iOS and Google Play Billing on Android. Those stores — not us — are the merchants of record: they take the payment, issue the receipt, charge any applicable tax and handle refunds.

6.1 What is on offer

Color Mint Plus benefits, for as long as the subscription is active: no banner or full-screen ads, unlimited free hints, and every bottle shape and background. Bottle shapes and backgrounds you bought with coins stay yours after Plus ends; the ones you used only through Plus go back to locked, and the Game switches to a free style. Rewarded ads remain available if you choose to watch them.

Prices are shown in US dollars as a guide only. The price you pay is the one displayed in the Game and in your app store at the time of purchase, in your local currency, including any applicable taxes. Prices vary by country and may be lower in your region.

6.2 How Color Mint Plus renews

• Payment is charged to your Apple Account or Google Play account when you confirm the purchase.
• The subscription renews automatically at the same price and for the same period unless you cancel it at least 24 hours before the end of the current period.
• Your account is charged for the renewal within the 24 hours before the current period ends.
• You can manage or cancel the subscription at any time in your store account: iPhone Settings → your name → Subscriptions, or Google Play → Payments & subscriptions → Subscriptions. The "Manage subscription" button in the Game opens the same page. Uninstalling the Game does not cancel a subscription.
• Cancelling stops future charges. Plus stays active until the end of the period you have already paid for; we do not give partial refunds for unused time.
• Switching between the monthly and yearly plan is done in the same store settings. The store decides when the change takes effect.

6.3 Free trials and introductory offers

If a free trial or introductory price is offered, its length and the price that follows it are shown before you confirm. Unless you cancel at least 24 hours before a free trial ends, it converts automatically into a paid subscription and your account is charged. A trial is available once per store account.

6.4 Price changes

We may change subscription prices. Where the law or the store requires it, you will be told in advance and asked to agree, or given the chance to cancel before the new price applies.

6.5 Delivery and restoring

• Coins are added to your balance as soon as the store confirms payment. They are consumed on delivery and stored on your device only.
• Remove Ads and Color Mint Plus are tied to your store account. Use Restore Purchases in the Game to get them back after reinstalling or on a new device signed in to the same account.

6.6 Refunds

Refunds are handled by the store you bought from, under its policy: Apple's Report a Problem or Google Play refunds. We cannot issue refunds for store purchases ourselves. If you are a consumer in the EEA or the UK, you have a statutory right of withdrawal within 14 days of purchase; this right is lost once digital content has been delivered with your consent, which for coins happens immediately. If a purchase is refunded, we may remove the coins, the Remove Ads unlock or the Plus benefits it paid for. Nothing here limits rights you have under mandatory consumer law.

6.7 Unauthorised purchases

You are responsible for purchases made on your device, including by children with access to it. We recommend enabling purchase authentication and parental controls in the App Store or Google Play.

7. Advertising

The free version of the Game shows banner ads, full-screen ads between levels, and optional rewarded video ads that grant coins. Ads come from third-party networks, principally Google AdMob. We do not control and are not responsible for the content of third-party ads or for the products, websites or offers they lead to; your dealings with an advertiser are between you and them. How ad data is handled is explained in our Privacy Policy.

8. Your progress and data

Game progress — levels, stars, coins, unlocked items and settings — is saved on your device, not on our servers. We are not liable for progress lost through uninstalling the Game, clearing its data, switching device, device failure or a change in operating system behaviour. The Remove Ads purchase can be restored through your store account.

9. Intellectual property

The Game and everything in it — the name "Color Mint", our logos, artwork, level design, code, sounds and music — is owned by us or our licensors and is protected by copyright and trade mark law. Nothing in these Terms transfers any of those rights to you. You may capture and share screenshots and gameplay videos for non-commercial, personal use, including on social media, provided you do not suggest that we endorse you.

10. Updates and availability

We may release updates, and some updates may be required for the Game to keep working. We may also change, suspend or discontinue the Game, or any feature of it, at any time. If we permanently shut the Game down, we will give reasonable notice where practical.

11. Termination

You may end this agreement at any time by uninstalling the Game. Uninstalling does not cancel a Color Mint Plus subscription — cancel it in your store account. We may suspend or end your access if you breach these Terms, if we are required to by law, or if we discontinue the Game. On termination, your licence ends and unused coins and virtual items are forfeited, except where consumer law says otherwise.

12. Disclaimers

The Game is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Game will be uninterrupted, error-free, free of harmful components, or that every generated level is solvable in a particular number of moves, or that defects will be corrected. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

13. Limitation of liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential or punitive damages, nor for loss of data, lost progress, lost coins, lost profits or device damage, arising out of or in connection with the Game. Our total liability for all claims relating to the Game is limited to the greater of (a) the amount you paid us or the app store for the Game and its in-app products in the 12 months before the claim, and (b) USD 20.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection law.

14. App store terms

Your use of the Game is also subject to the rules of the store you installed it from (Google Play or the Apple App Store), and if there is a conflict for purchases and refunds, the store's terms apply to that transaction.

For the Apple App Store: these Terms are between you and us only, not with Apple. Apple has no obligation to provide maintenance or support for the Game. If the Game fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Game. Apple is not responsible for addressing any claim relating to the Game, including product liability, legal or regulatory non-compliance, or consumer protection claims, and is not responsible for investigating or resolving third-party intellectual property claims relating to the Game. You confirm that you are not located in a country subject to a US Government embargo and are not on any US Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. Governing law

These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-laws rules, and the courts of Pakistan have non-exclusive jurisdiction over any dispute. If you are a consumer resident elsewhere, this does not deprive you of the protection of the mandatory consumer law of your country of residence, or of the right to bring proceedings in your local courts.

Before starting formal proceedings, please contact us — most issues can be resolved by email within a few days.

16. Changes to these terms

We may update these Terms as the Game develops or the law changes. The "Effective date" above will change, and material changes will be notified in the Game or the store listing. Continuing to play after an update means you accept the revised Terms. If you do not accept them, uninstall the Game and cancel any subscription.
